Membership Agreement: Vivahasphurthi Terms & Conditions

Effective Date: December 11, 2025 (Subject to periodic revision by Vivahasphurthi)

This binding agreement is between Vivahasphurthi (referred to as "Vivahsphurthi," "Website," "Platform," "we," "us," or "our"), owned by Vaishnavi Rakesh Sawant (Director, Vivahasphurthi LLP, Bengaluru - 560066), via the domain www.vivahsphurthi.com, and YOU, the individual accessing or using our services (referred to as "Member," "Customer," "you," or "User"). Access signifies use by you or on behalf of another (e.g., parent for child).

By accessing, registering, or using any services on www.vivahsphurthi.com, you explicitly confirm that you have read, understood, and agree to be legally bound by ALL terms and conditions outlined herein and in our Privacy Policy. If you disagree with any part, you MUST cease using this Website immediately.

1. Legal Framework

1.1. Electronic Record: This document constitutes an electronic record under the Information Technology Act, 2000 (and amendments). It is system-generated and requires no physical/digital signature.

1.2. Regulatory Compliance: Published per the Information Technology (Intermediaries Guidelines) Rules, 2011, outlining rules, privacy policy, and usage terms for www.vivahsphurthi.com.

2. Intermediary Platform

2.1. Platform Only: Vivahasphurthi operates solely as an online platform displaying information uploaded by its registered Members.

2.2. Role: We act as an intermediary, enabling Members to voluntarily register, search profiles, and seek lawful matrimonial alliances for themselves or specified family members (son, daughter, etc.). Profile creation assistance may be offered, but you are solely responsible for providing accurate, truthful information, including a valid phone number and email address.

3. Membership Terms

3.1. Purpose: Your sole, legitimate intention must be to seek a lawful matrimonial alliance.

3.2. Acceptance & Duration: You must accept these Terms and the Privacy Policy to become a Member. Standard membership lasts one (1) year, renewable annually.

3.3. Binding Agreement: Use of Vivahsphurthi services confirms your agreement to these Terms.

3.4. Mandatory Information & Verification: You MUST provide your full legal name, valid government-issued ID proof, current address proof, income proof (if applicable), education proof, a valid/operational email address, and a valid/operational mobile number during registration or within seven (7) calendar days thereof. Failure to provide mandatory documents will result in restricted access or account termination without refund.

3.5. Primary Communication: Your provided email and mobile number are the primary methods for all official communication.

3.6. Password Security: You are solely responsible for maintaining the confidentiality of your account password. Vivahasphurthi is NOT liable for losses due to your failure to secure your credentials.

3.7. Prohibited Code: Transmitting worms, viruses, spam, or any destructive code is strictly forbidden.

3.8. Lawful Use Only: Using Vivahasphurthi services for illegal or unauthorized purposes, or violating any laws (local, national, international) is strictly prohibited.

3.9. Non-Agreement: If you disagree with these Terms, do not access or use the Website.

3.10. Single Profile Rule: Multiple profiles for the same individual are prohibited. Vivahasphurthi reserves the right to deactivate/block duplicates without notice or refund.

3.11. No Promotion of Competitors: Using the platform to promote other matrimonial services, websites, apps, or companies is strictly prohibited.

3.12. Non-Commercial Use: The Website is strictly for personal, non-commercial matrimonial purposes.

3.13. Community Focus: Vivahasphurthi primarily serves the Maharashtrian Telugu, Tamil, Gujarati, Jain, Marwari, Hindu and Kannada communities, including those residing in India and abroad.

4. Data Security & Privacy

4.1. Commitment: We prioritize the security of your personal information.

4.2. Payment Gateway: Secure third-party payment gateways are used for transactions. Review their specific terms and conditions. Vivahasphurthi is not liable for gateway operations.

4.3. Confidentiality: We employ reasonable systems to maintain confidentiality of personal information not intended for public profile display.

4.4. Feedback: Any feedback you provide is considered non-confidential. We may use it without restriction or compensation to you. You confirm feedback contains no third-party confidential information.

4.5. Automated Processing: You consent to automated processing of your information for generating match suggestions and related communications.

4.6. Privacy Policy: Our Privacy Policy, integral to these Terms, details data handling practices. Read it carefully.

5. Content Disclaimer

5.1. No Guarantees: Vivahasphurthi does not guarantee that information uploaded by other Members will meet your expectations. We act only as an intermediary platform. Content is Member-provided and unverified by us.

6. Fees and Payment

6.1. Compliance: Payments (Cash, Cheque, Card, NEFT, Net Banking) adhere to prevailing RBI guidelines.

6.2. Purpose of Fee: Payment grants access to view profiles uploaded by other Members on the platform for the duration of the membership term.

6.3. Online Payment: Third-party gateways facilitate online payments; review their terms.

6.4. Activation: Service activation requires successful payment realization.

6.5. Dishonored Payments: You are liable for any bank charges incurred due to dishonored payments (e.g., bounced cheques).

6.6. Deactivation on Payment Failure: Vivahasphurthi reserves the absolute right to deactivate accounts immediately, without notice, if payment fails (e.g., cheque dishonor) after any initial activation.

6.7. Non-Refundable: All membership fees once paid are strictly non-refundable under any circumstances.

7. Information Provided by Members

7.1. Mandatory ID Proof: Valid government-issued ID proof MUST be submitted at registration for full feature access. Failure results in restricted access.

7.2. Mandatory Documents: Address proof, income proof (if applicable), education proof, and valid contact details MUST be provided within seven (7) calendar days of registration. Failure will lead to account blocking or permanent deletion without refund or notice.

7.3. No Liability for Others' Content: Vivahasphurthi is NOT responsible for the accuracy or truthfulness of information uploaded by other Members.

7.4. Honesty Required: You MUST complete registration truthfully and accurately.

7.5. Service Purpose: Services facilitate finding life partners via automated searching, shortlisting, and contact among registered Members.

7.6. Profile Sharing: You consent to your profile details being shared on the website "as is" and potentially with other Members within the MCL consortium of websites (if applicable).

7.7. Accuracy of Selections: Information selected during registration (e.g., caste, education) MUST be true. Package applicability may depend on these selections.

7.8. Changes & Fee Adjustments: If you modify profile information post-registration, membership charges may vary. If charges increase, you MUST pay the difference immediately. If charges decrease, Vivahasphurthi will refund the difference.

7.9. Self-Service Platform: The website primarily provides an interface for Members to search independently.

7.10. System Results: Search results are generated from registered Member profiles only.

7.11. Match Logic: Automated matches are based on preferences set by Members compared against your profile.

7.12. No Guaranteed Results: Vivahasphurthi does NOT guarantee specific results from using the service or data.

7.13. Third-Party Services: We may facilitate third-party services (e.g., horoscope matching). We are NOT responsible for their quality or accuracy. Payments collected for these are on behalf of the third party.

8. Member Responsibilities & Conduct

8.1. Credential Security: Keep your username and password confidential; do not share them.

8.2. Profile Changes Impact: Modifying your profile may alter system-generated match results.

8.3. Due Diligence: You are solely responsible for exercising caution, conducting due diligence, and verifying information provided by other Members before making any decisions.

8.4. No Liability for Misrepresentation: Vivahsphurthi is NOT responsible for misrepresentations made by other Members.

8.5. Independent Verification Required: Vivahsphurthi does NOT conduct background checks. You MUST independently verify prospects' credentials (family, income, education, character, health, marital status, location, etc.). Relying solely on profile information or the 'Verified' tick is at your own risk.

8.6. Photographs: Provide recent, clear photographs of yourself only. Third-party photos are prohibited.

8.7. Authentic Photos Only: Upload only genuine, unaltered photographs. Morphed, AI-generated, or manipulated images are strictly prohibited. Violation will result in immediate profile deactivation without refund.

8.8. Matrimonial Purpose Only: Registration MUST be solely for seeking matrimonial alliances.

8.9. Profile Completion: You will receive reminders to complete your profile. Failure to complete it will restrict access to certain package features.

8.10. Notification of Marriage: Upon finalization of marriage, you MUST inform Vivahsphurthi promptly (in person, letter, or email).

8.11. Profile Deletion: Profiles are automatically deleted upon membership expiry (unless renewed) or notification of marriage, whichever occurs first.

8.12. Personal Use Only: Search for proposals only for the registered individual. Using the service for third parties will result in immediate membership termination without refund.

9. Advertising

9.1. Third-Party Ads: Vivahsphurthi may display "Featured Ads" from other service providers for a fee.

9.2. No Endorsement: We are NOT liable for the content or quality of featured ads. Display does NOT imply endorsement or guarantee.

10. Intellectual Property

10.1. Ownership: Vivahsphurthi owns all intellectual property rights related to the Website and services, excluding Member-uploaded content. Infringement will result in legal action.

10.2. Prohibition: You MUST NOT infringe upon Vivahasphurthi's intellectual property rights (copying, modifying, transmitting, distributing, etc.).

11. Communication Consent

11.1. Methods: You consent to Vivahsphurthi communicating via email, phone calls (live or recorded), SMS, etc., using the contact details you provide.

11.2. Content: Communications may include service information, updates, new features, or related activities. You confirm your number is not on DND registries.

11.3. Implied Consent: Registration constitutes consent to these communications. You agree not to file complaints regarding such contact, which is considered transactional/service-related, not solely promotional.

12. Chat Feature Usage

12.1. No Liability: Vivahsphurthi is NOT responsible for information exchanged or language used between Members via chat.

12.2. No Control: We have no control over Member-to-Member chat interactions.

12.3. Prohibited Language: Use of improper, derogatory, offensive, or illegal language in profiles, chats, or anywhere on the platform is strictly prohibited. Violation will result in immediate profile blocking/deletion without refund or notice.

13. Special Categories (Remarriage)

These terms apply in addition to all others for Members seeking remarriage. They do not apply to first-marriage seekers.

13.1. Legally Separated

i. Document Required: Must provide a certified copy of the court order of separation.

ii. No Authenticity Guarantee: Vivahsphurthi does NOT verify the authenticity of court orders.

iii. Member Responsibility: You MUST independently verify the authenticity of any such order provided by a prospect.

13.2. Divorced

i. Document Required: Must provide a valid certified copy of the Decree of Divorce and Judgment.

ii. No Authenticity Guarantee: Vivahsphurthi does NOT verify the authenticity of divorce decrees.

iii. Member Responsibility: You MUST independently verify the authenticity of any such decree provided by a prospect.

13.3. Awaiting Divorce

i. Documents Required: Must provide certified copies of the divorce petition and list of documents filed in court.

ii. No Authenticity Guarantee: Vivahsphurthi does NOT verify the authenticity of these court filings.

iii. Member Responsibility: You MUST independently verify the authenticity of any such documents provided by a prospect.

14. Indemnity

You agree to defend, indemnify, and hold harmless Vivahsphurthi, its directors, officers, employees, and assigns from ANY and ALL claims, damages, losses, liabilities, costs, debts, and expenses (including attorney's fees) arising from:

• i. Your use of and access to the Website/Services.
• ii. Your violation of any term in this agreement.
• iii. Your violation of any third-party right (including privacy).

This indemnification obligation survives the termination, modification, or expiration of these Terms.

15. Capacity to Contract

15.1. Age: You MUST be at least 18 years old (if female) or 21 years old (if male) to register and use the services.

15.2. Mental Capacity: You MUST be of sound mind.

15.3. Legal Capacity: You MUST be legally capable of entering into a binding contract.

15.4. No Liability for Violation: Vivahsphurthi is NOT responsible if you violate these eligibility criteria.

16. Right of Admission & Usage Restrictions

16.1. Age Compliance: Adherence to age requirements (18F/21M) is mandatory.

16.2. Legal Competence to Marry: You MUST be legally competent to marry under applicable laws.

16.3. No Legal Prohibition: You confirm no existing law prevents you from entering into a valid marriage.

16.4. Prohibited Use: Misusing site information or images for recreational, pornographic, or commercial purposes, or reposting content elsewhere, is strictly forbidden.

17. Currency

17.1. Currency & Payments: All transactions are processed in Indian Rupees (INR). Refer to payment gateway terms for online transaction details.

18. Membership Renewal & Duration

18.1. Renewal Window: Renewal options become available one (1) month before your membership expiry date.

18.2. Late Renewal: Renewals processed more than one (1) month *after* expiry may be treated as new memberships.

18.3. No Suspension: Membership cannot be paused or put on hold during its active period for any reason.

19. Inter-Member Disputes

19.1. No Liability: Vivahsphurthi is NOT responsible for disputes arising between Members.

19.2. Sole Responsibility: You are solely responsible for your interactions and communications on the Website.

19.3. Not a Broker: Vivahsphurthi does not act as a broker for any Member.

19.4. No Obligation to Monitor: We have no obligation to monitor or mediate disputes between Members.

19.5. No Involvement: Vivahsphurthi will not be party to any disputes between Members.

20. Governing Law & Jurisdiction

20.1. Territorial Jurisdiction: All Members are deemed to have entered this agreement within the jurisdiction of Pune, Maharashtra, India.

20.2. Governing Law: This agreement is governed by the laws of the Republic of India. Exclusive jurisdiction for any disputes rests with the appropriate courts in Karnataka, India.

21. Content Ownership & License

21.1. Platform Ownership: www.vivahsphurthi.com domain and all content (excluding Member-provided content and third-party ads) belong to Vivahsphurthi.

21.2. Member Content Responsibility: You are solely responsible for all content you provide (profile information, posts, communications). You confirm you own or have rights to this content.

21.3. License Grant: By submitting content, you grant Vivahsphurthi a worldwide, royalty-free, transferable, sub-licensable license to use, publish, display, distribute, advertise, and reproduce your content in connection with the services. This includes potential use for legal/regulatory compliance.

21.4. Infringement: Unauthorized copying, modification, transmission, or commercial use of Vivahsphurthi's proprietary information will result in legal action.

21.5. Right to Remove Content: Vivahsphurthi reserves the right to delete, without notice, any Member content deemed offensive, illegal, harmful, defamatory, obscene, or against public policy.

22. Breach of Terms

22.1. Grounds for Termination: Vivahsphurthi reserves the right to immediately terminate your membership and deactivate your profile without notice or refund if:

• We receive complaints (or determine suo motu) that you are using the platform for non-matrimonial purposes (e.g., seeking physical favors, financial help, relationships other than marriage).
• Your profile information is found to be untrue, fake, false, or misleading.

22.2. Consequences: Termination provisions (Clause 29) will apply.

23. Membership Packages

Vivahsphurthi offers various membership packages (e.g., Basic, VIP, Premium VIP). Specific features and limitations depend on the package selected and are detailed on the Website/App.

23.1. Package Tiers: Details available on the Website. Basic includes limited contact views; higher tiers offer more access and features.

23.2. Upgrades: Upgrading is possible; features vary by package.

23.3. General Provisions (Applicable to All Packages)

i. No Investigation: Vivahsphurthi does NOT conduct independent investigations of profiles.

ii. Profile Completion: Complete profile with at least one mandatory photo required.

iii. Verification Mark: Document verification (Address, Income, Education, ID) may result in a 'Verified' sign, but does not guarantee authenticity (See Clause 27).

(Detailed features like contact limits, chat access, save search, guidance sessions, 'who viewed profile', event discounts, priority listing, premium badge are outlined under respective package descriptions on the website/app).

23.8. Upgrades & Expiry

i. Upgrading a package does NOT change the original membership expiry date.

ii. You gain access to upgraded features for the remainder of your existing membership term upon successful payment of the upgrade fee.

24. Session Recording Consent

24.1. Recording: Counselling/guidance sessions may be recorded for quality assurance and training purposes.

24.2. Video On: You MUST keep your video switched on during these sessions.

24.3. Consent: Participation in these sessions implies your explicit consent to the session being recorded by Vivahsphurthi.

25.2. Complaint Acknowledgement: Complaints submitted via the Grievance Officer email will be acknowledged within 24 hours and addressed according to statutory timelines under Indian law.

26. Limitation of Liability

26.1. No Endorsement: Profile exchanges or suggestions via Vivahsphurthi do NOT constitute matrimonial advice, recommendation, or guarantee.

26.2. No Consequential Damages: Vivahasphurthi (including directors, officers, employees, agents) is NOT liable for any direct, indirect, incidental, or consequential damages arising from website/service use.

26.3. Liability Cap: Our maximum liability, under any circumstance, is strictly limited to the membership fee amount you paid to Vivahsphurthi.

26.4. No Post-Marriage Liability: We are NOT responsible for wrong matches, marital discord, divorce, or any issues arising after marriage.

26.5. Staff Interactions: We are not liable if a staff member contacts another member with a proposal that is not reciprocated.

26.6. Member Agreements: We are not responsible for any agreements or interactions made directly between Members.

27. Profile Verification

27.1. 'Verified Tick': A 'verification tick' may be added after comparing submitted documents against profile information.

27.2. Limited Scope: Verification is limited ONLY to the documents provided. Information without documentation is NOT verified.

27.3. No Guarantee of Authenticity: We accept documents as provided. We are NOT liable if documents are forged, false, incorrect, or tampered with.

27.4. No Investigation Duty: We do NOT investigate the validity of submitted documents (e.g., confirming degrees with universities). It is not our duty or responsibility.

27.5. Not a Guarantee: The 'verification tick' is NOT a guarantee or surety from Vivahsphurthi regarding the member's authenticity or the veracity of their submitted documents.

27.6. Member Responsibility: You MUST still independently verify documents and information of prospects, even those with a 'verified tick'. Vivahsphurthi will NOT share submitted documents with other Members.

28. Events & Melas

Vivahsphurthi may conduct matrimonial events (Melawas). Registration is available online/offline.

28.1. Check Criteria: Before registering, carefully read all eligibility criteria (Age, Marital Status, Caste, etc.).

28.2. Event Refund Policy

Refunds for event cancellations are issued ONLY as follows:

• Full Refund (100%): Cancellation 21 days or more before the event.
• Partial Refund (50%): Cancellation 15 to 20 days before the event.
• Partial Refund (25%): Cancellation 7 to 14 days before the event.
• NO Refund: Cancellation less than 7 days before the event.
• NO Refund for Non-Attendance: No refund will be provided if you register but do not attend. Attendee lists shared only with present attendees.
• GST Note: Refunds processed in the same calendar month include GST; refunds processed in subsequent months exclude GST.

28.3. Non-Transferable: Event registration is strictly non-transferable.

28.4. Punctuality: Arrive at the venue 15 minutes before the scheduled start time.

28.5. ID Required: Carry valid photo ID proof for event entry.

28.6. Additional Terms: You may be notified via email of any additional event-specific terms.

29. Termination of Membership

29.1. Right to Terminate: Vivahsphurthi reserves the absolute right to terminate your membership and deactivate your profile immediately, without notice or reason, for any violation of these Terms & Conditions.

29.2. Forfeiture upon Termination: Upon termination by Vivahsphurthi due to your breach, all fees paid will be forfeited. No refunds will be issued.

29.3. Cessation of Services: Upon termination, your right to use Vivahsphurthi services ceases immediately.

29.4. Survival: Obligations arising prior to termination (e.g., Indemnity - Clause 14) survive termination.

30. Modifications to Terms

30.1. Modification Right: Vivahsphurthi reserves the right to modify these Terms and Conditions at any time without prior individual notice. Review this page frequently.

30.2. Notification & Acceptance: Material changes will be notified via this page. Continued use of the Website or services after changes are posted constitutes your binding acceptance of the modifications.
